Terms of Use — Asidu
Asidu ("the App") is provided by Nicolas Burri Studio GmbH, Flüelastrasse 16, c/o Genossenschaft Atelier Uto, 8048 Zürich, Switzerland, UID CHE-470.128.392 ("we", "us"). Studio Flysch is a brand of Nicolas Burri Studio GmbH.
1. Relationship to Apple's licence and acceptance
Your licence to use the App is governed by Apple's Licensed Application End User License Agreement (Standard EULA). These Terms supplement it with rules specific to Asidu. If a provision of these Terms conflicts with the Standard EULA, the provision more favourable to you applies.
You accept these Terms by tapping "Agree and continue" when you set up the App. We store the version and date of your acceptance on your device.
2. Who can use Asidu
You must be at least 18 years old to use Asidu.
3. What Asidu is
Asidu provides general, non-medical information and estimates about nutrition and training for healthy adults. It does not provide medical, dietetic or individual nutritional advice and is not a medical device.
Asidu is not designed for people who have or have had an eating disorder, who are pregnant or breastfeeding, or whose nutrition is affected by a medical condition. If this applies to you, please only use Asidu after talking to a qualified professional.
All values — energy expenditure, targets, carryover, trends, outlooks, fueling and race-preparation suggestions, recovery signals and cycle corrections — are estimates based on general formulas, sports-nutrition guidelines, third-party data and your own entries. They can be wrong for you. Fueling and race-preparation suggestions are general guidance from published sports-nutrition guidelines, not an individual plan. Recovery signals describe your recorded data; they are not an assessment of your health or of whether you should train. See also the Health Disclaimer.
4. AI features
AI output can be wrong or incomplete. Check it before you save it, especially for allergens and ingredients that matter to you. AI meal suggestions and cooking steps are not tested recipes; follow usual food-safety practice. Imported recipes remain the content of the website they come from. Don't submit photos of other people, other people's documents or unlawful content.
5. Your data
Your diary is stored on your device (see the Privacy Policy). Please back it up with your iPhone backup or "Back up now" (Profile → Data); we can't restore data we never had. Food data comes from third-party sources (Swiss Food Composition Database, Open Food Facts, FatSecret) and can contain errors.
6. Licence restrictions
You may not copy, modify, reverse-engineer or decompile the App except where the law allows it, use it to build a competing product, bulk-extract data, or circumvent usage limits, purchase checks or the AI allowance (for example with forged or borrowed purchase records, manipulated requests or automated use). We may block AI access for a purchase that shows such use.
7. Subscriptions, Lifetime and AI credits
- Subscriptions are billed by Apple, renew automatically unless cancelled at least 24 hours before the end of the current period, and are managed in iOS Settings → Apple ID → Subscriptions. A free trial converts into a paid subscription unless cancelled before it ends.
- AI allowance. Asidu Pro subscriptions include a monthly AI allowance for everyday use plus a daily limit, measured by the cost of the AI requests we pay for on your behalf; a long recipe or a photo uses more of it than a short text. A trial has a fixed allowance for the whole trial. When the allowance is used up, AI features pause until it resets; barcode scanning, favourites, manual entry and all other features are not affected. The App tells you when you approach the limit.
- Asidu Pro Lifetime is a one-time purchase. It unlocks all Asidu Pro features, including Pro features we add later, for the lifetime of the App ("lifetime" means as long as we offer the App, not your lifetime or that of a device). It does not include AI features or an AI allowance. Server-based services (food search, barcode lookup, calendar recognition) are included as long as we offer them; features that run on your device keep working without our server. Separately offered new products or services are not included. Lifetime is not available through Family Sharing. With Lifetime, online recognition of unclear calendar titles is limited to 50 per month; after that, recognition continues on your device. If you have a subscription and buy Lifetime, the subscription isn't cancelled automatically — cancel it in iOS Settings.
- AI credits are a consumable purchase, usable with or without a subscription, and do not expire (except as described in Section 9). Each AI action uses the number of credits shown in the App before you use it. If we ever increase the number of credits an action uses, the increase only applies to credits purchased after we announced it; credits already in your balance keep the previous rate. If a subscription's allowance is used up, the App asks before it starts using credits. If a request fails or its answer is cut off, the credits are returned automatically. Credits have no cash value and cannot be transferred or exchanged.
- Refunds. Purchases are processed by Apple. Refund requests are handled by Apple (reportaproblem.apple.com). This does not affect your statutory rights. If Apple refunds a subscription, AI access for it ends. If Apple refunds a credit purchase, those credits are removed from your remaining balance; credits you have already used are not charged again, and your balance never becomes negative.
- Restoring. "Restore Purchases" restores subscriptions and Lifetime and reconnects an existing credit balance; it never credits a purchase twice.
- Prices are set in the App Store and can change; price changes for subscriptions apply under Apple's rules.
8. Changes to the App and to these Terms
We may change or remove a feature only for a valid reason — technical, legal or security reasons, or because a provider we rely on changes or ends its service. We will tell you about significant changes in the App.
We will announce changes to these Terms in the App at least 30 days before they take effect and ask for your acceptance. Purchases you have already made are not affected. If you don't agree, you can stop using the App and cancel your subscription before the changes take effect.
9. Discontinuation
If we decide to discontinue the App or its server-based services, we will announce this in the App and on asidu.app at least six months in advance. From the announcement, we will no longer sell Lifetime, AI credits or new subscriptions. Server-based services remain available until the end of the notice period and at least until the end of any subscription period you have already paid for. You can use remaining credits during the notice period. Features that run on your device continue to work as long as your device's operating system supports the installed App. Your statutory rights remain unaffected.
10. Transfer
We may transfer the App, together with these Terms and our rights and obligations under them, to another company that continues to operate the App. Your rights under these Terms remain unchanged. We will inform you in the App before the transfer takes effect.
11. Availability and warranty
We work to keep Asidu reliable, but we don't guarantee that server-based features are always available or that estimates are accurate for you. Your statutory warranty rights remain unaffected.
12. Liability
Nothing in these Terms limits or excludes our liability for intent or gross negligence, for injury to life, body or health, or under mandatory product liability law. Otherwise, to the extent permitted by law, we are not liable for slight negligence. Your statutory rights as a consumer remain unaffected.
13. Apple
Apple is not responsible for the App, its content, maintenance or support. To the extent a warranty claim exists, you may notify Apple, which will refund the purchase price; Apple has no other warranty obligation. We, not Apple, are responsible for claims relating to the App, including product liability, legal or regulatory compliance and intellectual property. Apple and its subsidiaries are third-party beneficiaries of these Terms.
14. Governing law and jurisdiction
These Terms are governed by Swiss law, without prejudice to mandatory consumer protection provisions of your country of residence. If you are a consumer, you may bring proceedings at the courts of your place of residence or in Zurich, Switzerland; we may bring proceedings against you only at the courts of your place of residence.
